1. Agreement and eligibility
These Terms of Service form an agreement between you and Song Memorials for your use of songmemorials.com and the related digital service. By using the service or placing an order, you agree to these terms and our Privacy Policy.
You must be at least 18 years old and able to enter a binding agreement. If you submit information or content about another person, pet, family, or contributor, you are responsible for having the authority and permissions needed to do so.
2. The Song Memorials offer
The launch offer is a one-time purchase of $49 USD. It includes exactly one final custom memorial song, generally about three minutes long, one printable digital lyric art PDF, and one unlisted memorial page. The memorial page includes the active song, lyrics, a cover, photos, and comments. It also includes lifetime hosting, unlimited rewrite requests made in good faith, and the money-back guarantee described below.
The offer does not include three songs, bonus songs, a Digital Gift, a Song Video, a physical print, shipping, rush delivery, bundles, or add-ons. Lyric art is a digital PDF that you may print yourself. No personalized song preview is promised or delivered before payment. Generation starts only after payment is confirmed.
The price, inclusions, and version saved with your order control that order. Internal creative candidates are not separate products and do not increase the number of songs included. When a rewrite is approved, it replaces the active public song rather than adding another song to your order.
3. Assisted creation and creative results
Song Memorials uses assisted generation technology, which may include artificial intelligence, together with production workflows and quality review. By ordering, you authorize us and our production providers to process the details you submit for the purpose of creating and delivering your memorial song and related assets.
Creative work is interpretive. We cannot guarantee a specific melody, vocal likeness, emotional reaction, or exact artistic outcome. We do not accept requests to imitate a living artist or to reproduce protected music or lyrics. Rewrite requests must stay reasonably connected to the original memorial brief. We may refuse requests that are unlawful, abusive, unsafe, infringing, or technically infeasible.
4. Your stories and submission rights
You keep ownership of content you submit. You grant Song Memorials a worldwide, non-exclusive, royalty-free license to host, copy, adapt, process, display, and distribute that content only as reasonably needed to operate, secure, moderate, support, and improve your order and memorial experience.
You represent that submitted content:
- is accurate to the best of your knowledge;
- does not violate another person's privacy or other rights;
- does not infringe copyright, trademark, or other property rights;
- is not unlawful, threatening, deceptive, hateful, or exploitative;
- does not contain malware or attempt to interfere with the service.
We will use the memories and facts you provide. We do not promise to research or independently verify them, and we do not create factual obituary details that you did not provide.
5. Song and lyric art license
To the extent permitted by applicable law, Song Memorials grants the buyer a perpetual, worldwide, non-exclusive license to download, print, play, share, and display the delivered song and lyric art for personal memorial and family use. Commercial distribution, monetization, resale, sublicensing, or registration as solely your own work requires our prior written permission.
Laws concerning authorship and copyright eligibility for assisted generation vary. We do not promise that every element is eligible for copyright protection or that a generated musical element is exclusive to you. Song Memorials retains its rights in the platform, brand, software, templates, and production methods.
6. The unlisted memorial
Your memorial is published automatically as unlisted. Unlisted does not mean private. Anyone who receives the public link may view the page, play the song, read the lyrics and comments, view approved photos, share the link, and contribute while contributions are open. The page is excluded from our sitemap and marked not to be indexed, but search engines and third parties may not always honor those signals.
The public link never grants editing rights. The buyer controls the memorial through a separate owner access link and secure session. You are responsible for protecting owner access and for sharing the public link only with people you intend to invite. We may rotate a link or suspend a memorial when needed for security, safety, or legal reasons.
7. Comments, photos, and moderation
Visitors may submit a display name, a plain-text comment, and up to five photos per contribution after accepting the publication rights notice. Comments may appear immediately. Photos appear only after automated technical validation and processing. A processing state is not approval or endorsement by Song Memorials.
A contributor keeps ownership of their submission and grants Song Memorials and the memorial owner a non-exclusive, worldwide, royalty-free license to host, process, display, and share it on that memorial. The contributor confirms that they have permission from the photographer and any identifiable living people.
Owners, visitors, and administrators may report content. The owner or Song Memorials may hide, restore, or remove contributions, close contributions, or hide the memorial. Removed content is generally recoverable within the service for 30 days before the associated object is deleted. Security copies, legal holds, and disaster-recovery backups may persist longer where reasonably necessary.
8. Payment, rewrites, and money-back guarantee
Payment is processed by Stripe. The server-confirmed order price is $49 USD for the launch offer, plus any tax that we are legally required to collect. We do not store your full payment card number.
You may request unlimited rewrites in good faith within the original memorial brief. A rewrite may change lyrics, production direction, or the delivered recording, but it does not create an entitlement to additional active songs. We may ask clarifying questions and may group overlapping requests into one revision.
Under our money-back guarantee, the buyer may request a refund within 30 calendar days after the first song delivery by emailing support@songmemorials.com from the order email address. We may offer a rewrite or technical correction, but statutory refund rights and any rights that cannot lawfully be limited remain unaffected. Duplicate charges, verified non-delivery, and unresolved corrupted files are also eligible for correction or refund. Refunds return to the original payment method and may take additional time to appear.
9. Lifetime hosting and continuity
Lifetime hosting means that we intend to host the memorial without a recurring hosting fee for as long as the Song Memorials service continues to operate. It is not a guarantee that any particular vendor, URL, feature, or technical platform will remain unchanged or that access will never be interrupted.
We may migrate storage, update formats, change non-material features, or temporarily suspend access for maintenance, security, moderation, or legal compliance. If Song Memorials permanently discontinues memorial hosting, we will use commercially reasonable efforts to give owners advance notice and a practical opportunity to download their available song, lyric art, and exportable memorial content.
10. Communications and consent
Transactional email is necessary to confirm payment, report generation status, deliver the song, provide owner access, handle support, and notify you about material service or security issues. Transactional messages do not require marketing enrollment.
Marketing email consent and marketing SMS consent are separate, optional choices. Neither is a condition of purchase. If you opt in, you may withdraw consent using the unsubscribe link, replying STOP to an SMS where available, or contacting us. Message and data rates may apply. We will honor opt-out requests as required by applicable law.
11. Availability, warranties, and liability
We use reasonable care to provide the service, but internet, generation, payment, and storage systems can fail or be interrupted. Except for promises expressly stated in these terms and rights that cannot be excluded by law, the service is provided as available and without implied warranties.
To the maximum extent permitted by law, Song Memorials is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss caused by a public link shared outside your intended audience. Our aggregate liability relating to an order will not exceed the amount paid for that order. These limits do not apply where they are prohibited by law.
12. Suspension, changes, and contact
We may suspend or terminate access when reasonably necessary to stop fraud, abuse, rights violations, security threats, unlawful content, or material breach of these terms. We may update these terms for future use of the service. Material changes will be posted with a new effective date, and an order's saved commercial terms remain the record of what was purchased.
These terms are governed by the laws of Delaware, United States, without displacing consumer protections that apply mandatorily in your place of residence. If a provision is unenforceable, the rest remains effective.
